In order to guarantee you a pleasant stay and for us a pleasant cooperation, you will find our General Terms and Conditions below.

This agreement is entered into as soon as the payment of the deposit and cleaning costs (750,-) has been received.

These General Terms and Conditions (GTC) apply to all bookings of the Hochkeil Lodge.

Reference to “the owner”, “us”, “our” or “we” means Hochkeil Lodge, reference to “the guest” or “you” refers to the person or persons accepted by the owner to rent the Hochkeil Lodge for the period indicated in the booking and, if the context allows or requires it, all the persons mentioned on the booking form.

The guest is responsible for compliance with the Lodge rules provided by email after the reservation request.

  1. Reservation and payment

1.1 The first 48 hours after receipt of your reservation request you can cancel free of charge.

1.2 After the reservation request, Hochkeil Lodge will send you a separate invoice for the amount of the deposit of 750,- by email with the request to pay this within 7 days of receipt of the invoice. The reservation will be confirmed to you by e-mail after the amount of 750,- has been received.

1.3 After the reservation request you will also receive a separate invoice for the total rental amount (rent and tourist tax € 2,10 p.p.p.n > 15 years old) and cleaning fee ( € 250,-) by email. The request is to pay this amount no later than 12 weeks before the day of arrival. The expiration date is mentioned on the invoice. If the reservation is made less than 12 weeks before the arrival date, the total rental price (rental & tourist tax) must be paid at the time of reservation.

1.4 If the payment of the invoice for the deposit has not been received by the due date on the invoice, we reserve the right to treat the booking as cancelled as set out in the section ‘Cancellation by Guest’ (clause 3) below.

1.5 If payment of the invoice for the total rental has not been received by the due date on the invoice, we reserve the right to treat the booking as cancelled as set out in the ‘Guest Cancellation’ section (clause 3) below.

See clause 2 for a refund of the deposit.

  1. Deposit

2.1 Hochkeil Lodge will request a deposit of € 750. A separate invoice will be sent for this. The deposit serves as a guarantee for damage to and/or costs for the Hochkeil Lodge as a result of non-compliance with the obligations of the Guest (see Clause 5).

2.2 If costs are incurred for damage, to bring the Lodge back to an acceptable standard and/or excessive energy and water consumption, these costs will be deducted from the deposit. If these costs are higher than the deposit, the Hochkeil Lodge has the right to hold the guest liable for the additional costs.

2.3 The deposit of € 750 will be refunded 7 (seven) days after the rental period after settlement of claims (damage to inventory / accommodation, extra cleaning and / or excessive energy and water consumption).

2.4 In the event that the damage caused is not compensated immediately after the stay, the Hochkeil Lodge shall still be entitled to hold the guest liable for the compensation thereof. All costs associated with this are the responsibility of the guest.

2.5 The deposit shall be returned to the same bank account that was used for the payment.

  1. Cancellation by Guest

3.1 A Request for Cancellation must be sent by e-mail to enjoy@hochkeillodge.com. A Confirmation of Cancellation will be sent within 7 (seven) days of receipt of the Cancellation Request.

3.2 Refund after cancellation by the Guest is as follows:

  • Up to 10 weeks before arrival date – 50% refund of the total rental costs
  • Up to 8 weeks before arrival date – 40% refund of total rental costs
  • Up to 6 weeks before arrival date – 30% refund of total rental costs
  • Up to 4 weeks before arrival date – 20% refund of total rental costs
  • Up to 2 weeks before arrival date – 10% refund of the total rental costs
  • Less than 2 weeks before arrival date – 0% refund of total rental costs
  1. Change Reservation

4.1 Changes to a reservation can be made up to six weeks before arrival and the following terms and conditions apply:

  • A change request must be sent by e-mail to enjoy@hochkeillodge.com.
  • Hochkeil Lodge will only accept the change request if there is availability for the requested new dates and it is in the same year and season as the original request.
  • If the total rental price is higher for the newly requested dates, Hochkeil Lodge will send an invoice for the price difference by e-mail. The change request will only be processed after payment has been received.
  • If the total rental price is lower for the newly requested dates, Hochkeil Lodge will not refund the difference in total rental price.

4.2 If it is not possible to change the original reservation and the guest wishes to cancel the reservation, the cancellation policy will apply. Refer to clause 3 above.

  1. Liability and obligations of the Guest

5.1 During the stay in the Hochkeil Lodge, the guest is liable for damage to the Lodge, the furniture and all items related to the Lodge. Any damage to the Lodge caused by the Guest or other users who have been given access to the Lodge by the Guest will be compensated by the Guest.

5.2 Existing damage must be reported to the manager of the accommodation on the day of arrival. Damage not reported on the day of arrival is the responsibility of the guest.

5.3 Electricity and water are included in the rental price. However, excessive energy and water consumption will be charged.

5.4 Compliance with the rules of the Lodge (provided by e-mail) is mandatory.

5.5 The accommodation and the surrounding garden must be left in a clean and tidy state (according to the rules of the Lodge), all furniture must be returned to its original place and no furniture may be moved that could cause damage to the furniture and the floor.

5.6 The Guest is liable for additional cleaning costs, if the Lodge is left in excessively untidy and dirty condition.

5.7 The Lodge may only be shared with the persons mentioned on the booking form.

5.8 The total number of persons stated on the booking form may not be exceeded.

5.9 The Lodge can only be used for personal and domestic purposes.

5.10 It is not permitted to remove property or furniture from the Lodge.

5.11 It is not allowed to cause nuisance to neighbours.

5.12 The accommodation is non-smoking

5.13 Pets are not allowed in Hochkeil Lodge.

5.14 The Owner or his manager or contractors are entitled to access at any time (at reasonable times).

In the event of a breach of any of these terms and conditions, the Owner or his manager may immediately re-enter the property and terminate the rental and/or charge the Guest any additional costs and claim damages for all losses.

For a booking made under false pretences there will be no refund of deposit and total rental price and check-in will not be allowed.

  1. Liability of Hochkeil Lodge

6.1 The Owner accepts no liability for loss, theft or damage suffered by the Guest or the property of the Guest.

6.2 Hochkeil Lodge is not responsible for damage caused by natural disasters, terrorist attacks, strikes and other situations beyond the control of the Hochkeil Lodge.

6.3 The use of all facilities is at the guest’s own risk and responsibility.

6.4 Hochkeil Lodge is not liable for shortcomings in the services provided or defects in services provided by third parties.

6.5 WIFI

We offer a free and fast Wi-Fi internet connection in the Hochkeil Lodge. However, the speed is “as it is” and cannot be guaranteed as the Hochkeil Lodge depends on the provider. We are not liable for failure or unavailability of the Wi-Fi internet signal or connection.

If guests use our free Wi-Fi internet connection, they are solely responsible for compliance with all relevant laws and for ensuring that no computer or software virus, inappropriate or illegal material is opened or downloaded. The guest will be required to reimburse us in full for any computer or software virus that is downloaded and damages our software, systems or hardware and for any other consequences of using or downloading inappropriate or illegal material. It is the exclusive responsibility of each guest to ensure that any restrictions are present for children and we cannot accept any responsibility for inappropriate access or use of the Internet by children or others.

6.6 Sauna and wood burning stove

Guests are welcome to use the sauna and wood-burning stove, but do so entirely at their own risk. By agreeing to these terms and conditions, we agree that the owners of the Hochkeil Lodge and their staff are not liable for any injuries or loss of life suffered by the guests due to accidents or incidents in the sauna and with the wood stove.

The guest agrees that children must be supervised at all times.

For young children, pregnant women, persons under the influence of alcohol and persons with heart problems, the use of the sauna is not recommended.

  1. Unavailability of Hochkeil Lodge

7.1 If the Hochkeil Lodge has to cancel the reservation due to unforeseen circumstances, we will inform the guest of this as soon as possible. If possible, Hochkeil Lodge will propose an alternative option.

7.2 If the alternative option is not available or acceptable to the Guest, Hochkeil Lodge will refund the Guest in full any money already paid. The Guest has no rights other than the money already paid to Hochkeil Lodge.

  1. Maintenance

8.1 It may from time to time be necessary to carry out repair, maintenance or similar work on or in the premises and we reserve the right to carry out such work at any time without any compensation, refund or similar payment to the Guest. Of course this will be prevented as much as possible.

8.2 Similarly, we cannot accept any responsibility for construction, maintenance or repair work by neighbouring or other properties, nor for road works or utilities. No compensation, restitution or other payments shall be made in respect of such works.

  1. Website Information

9.1 The photographs and illustrations on our website may not reflect current furniture, decoration or furnishings; and we reserve the right to change furniture, decorations, room layouts and accessories at any time.

9.2 We reserve the right to change prices due to errors or changes.

9.3 Not all mentioned facilities and activities in the region are open/available all year round. Hochkeil Lodge is not responsible for this.

  1. Complaints

10.1 If you are dissatisfied with anything, please contact the administrator immediately (within 24 hours). If the complaint is not resolved satisfactorily within 24 hours after reporting, please contact us within 48 hours. We will be happy to help you. We also continuously strive to improve Hochkeil Lodge, so any feedback from you will be appreciated.

10.2 We regret that we cannot handle complaints in which we have not been given the opportunity to investigate the complaint and rectify the matter during the rental period; or complaints submitted on or after departure.

  1. Applicable law and jurisdiction

These Terms and Conditions constitute a binding agreement between you (the Guest) and us (the Owner) and shall be governed by and construed in accordance with Austrian law. This Agreement shall be subject to the exclusive jurisdiction of the Austrian courts.
